ГАРАНТИЙНОЕ ОБЯЗАТЕЛЬСТВО

на работы по ремонту т/х "_____", выполненные на верфи Исполнителя________ по контракту N ... от ________199_ г.	For repair work to m/v "_________" carried out at the Contractor's yard in accordance with the Contract No ... dated ____________199_.
Настоящим компания _____________ именуемая в дальнейшем "Исполнитель", дает гарантию ЧМП, Одесса в том, что:	The Company_______ herein after referred to as "The Contractor", hereby guarantee BLASCO, Odessa, that:
1. Ремонт судна полностью соответствует уточненной документации, согласованной с Исполнителем, Заказчиком и Регистром.	1. The repairs carried out on the Vessel comply fully with the final documentation as agreed with the Contractor, Owner and ... Register of Shipping.
2. В условиях нормальной эксплуатации судна гарантируется надежная и бесперебойная экс плуатация судна только по тем частям и оборудованию, которые подверглись ремонту.	2. Reliable and trouble free operation of the vessel are guaranteed in normal operation conditions only for those parts and equipment which where the subject of repairs.
3. Все материалы и изделия, которые применены в ремонте, по всем техническим данным отвечают требованиям Регистра ..., а монтаж и сборка обеспечивают нормальную эксплуатацию судна.	3. All materials and items used for the repair and/or refitting of the vessel comply fully with... Register of Shipping Requirements in respect of their technical characteristics, and their installation and assembly are to procure normal operational conditions of the vessel.
4. Исполнитель несет ответственность за все дефекты и недостатки, возникшие по причине недоброкачественного выполнения работ, плохой конструкции вновь устанавливаемых механизмов и оборудования, неправильного монтажа или применения недоброкачественных материалов в пределах ответственности Исполнителя.	4. The contractor is liable for all defects and deficiencies which may arise due to poor workmanship, defective machinery and equipment, newly installed, incorrect installation or use of defective materials up to the limit of liability specified in the Contract.
Эти выявленные дефекты и недостатки должны быть устранены Исполнителем бесплатно, а дефектные части, материалы и механизмы должны быть заменены новыми.	Such revealed defects and deficiencies are to be eliminated by the Contractor free of charge, and defective parts, materials and devices are to be replaced by new ones.
Гарантия не распространяется на быстроизнашивающиеся части и материалы.	The guarantee is not to be applied to normally short-time service components.
5. Если дефектные части требуют замены, Они будут заменены или поставлены Заказчику на условиях СИФ-порт, причем монтаж их на месте производится за счет Исполнителя, а срок гарантии для замененных механизмов и устройств начинает исчисляться с момента их замены.	5. If defective parts are required to be replaced, such replacement shall to be done or They are to be supplied to the Owner on C.I.F. terms port, in that case installation of the said parts shall be carried out at the Contractor's cost and the guarantee period for replaced devices and equipment is to be counted from the time of their installation.
6. Место устранения дефектов, выявленных в процессе эксплуатации судна, устанавливается по согласованию сторон.	6. The place where defects discovered during operation of the Vessel and which are subjected to elimination to be repaired is to be mutually agreed between the two parties.
В случае, не терпящем отлагательства, Заказчику предоставляется право устранять дефекты или недостатки за счет Исполнителя, в месте, которое Заказчик найдет наиболее подходящим, извещая об этом Исполнителя телеграфно.	In urgent cases, the Owner has the right to eliminate defects or deficiencies on the Contractor's account at a place which the Owner considers more convenient, having advised the Contractor to this effect by telex.
7. Стоимость работ по устранению дефектов и недостатков должна исчисляться в соответствии с пунктом 26 настоящего Контракта.	7. The cost of work carried out to eliminate defects and deficiencies is to be calculated in accordance with Paragraph No 26 of this Contract.
8. Срок гарантии на ремонт судна устанавливается 6 месяцев, начиная с даты подписания приемо-сдаточного акта, т. е. до_________ 199_ года, а на замененные механизмы - 12 месяцев с даты подписания приемо-сдаточного акта, т. е. до ___________199_ года.	8. The guarantee period for the repair to the vessel is fixed at 6 months, counting from the date of signing of the Redelivery protocol, and for newly-instal led equipment and new materials -12 months from the date of signing of the Redelivery protocol, i. е. th, __________199_.
9. Во всех случаях, когда судно для устранения дефектов в порядке выполнения гарантии выводится из эксплуатации на 10 дней, срок общей гарантии Исполнителя соответственно удлиняется на срок вывода судна из эксплуатации.	9. In a 11 cases when, for the purposes of repairs under the terms of the guarantee, the vessel puts out of operations for more than 10 days, the period of overall guarantee provided by the Contractor shall be extended for the equivalent period spent been out of operation.
10. Все рекламации должны быть оформлены в письменном виде. Заказчику предоставляется право предъявить Исполнителю рекламации в течение всего гарантийного срока, но не позднее 30 дней после его истечения при условии обнаружения недостатка в пределах срока гарантии, т. е. до _________199_ года.	10. All claims must be produced in writing. The Owner has the right to make claims against the Contractor throughout the full guarantee period, but not later than 30 days after its expiration, provided that any defects are discovered within the guarantee period, i. е. before th, ___________199_ .
11. Причины и время возникновения дефекта должны быть удостоверены Регистром ... или другим классификационным обществом. Исполнитель_________ Заказчик_________ Дата _______________	11, The causes and time of occurence of the defect must be certified by the ... Register of Shipping or other Classification Society. For the Owner ________ For the Contractor _________ Date _________ th. 199 .
